Privacy policy

1. Who processes the data

This policy describes what personal data we receive from visitors to terrasystems.kz and from people who contact us, why, where we store it and how we protect it. It follows the Law of the Republic of Kazakhstan No. 94-V of 21 May 2013 “On Personal Data and Their Protection”. The Russian version of this policy prevails.

2. What data we receive

Data you provide yourself when you message us on WhatsApp, call or email: your name, phone number, email address, company and position, and the content of your message. You can also give this data, along with information about your plant (stations, raw material volume, how tracking works, certificates and sales markets), in the questionnaire on the site, available in Russian and Kazakh.

Data collected automatically when you visit the site: cookies, IP address, device and browser type, referral source, pages viewed, time on site, clicks and scrolling. It is collected by the Yandex Metrica web analytics service, including Webvisor, which records actions on the page.

We do not collect biometric data, copies of identity documents, or information about health or beliefs.

3. Why we use it

• to reply to your enquiry and arrange a meeting or a yield audit;
• to prepare a proposal and to conclude and perform a contract;
• to understand which sections of the site are useful and improve it;
• to comply with the laws of the Republic of Kazakhstan.

We do not use the data for other purposes and do not collect more than these tasks require.

4. Consent

We process personal data with your consent. By contacting us by phone, WhatsApp or email, you consent to the processing of the data you provide so that we can reply and work on your request. The questionnaire on the site can only be sent after you tick consent to the processing of the data it contains and to its transfer to Telegram outside the Republic of Kazakhstan, as described in section 6.

On your first visit the site shows a notice about cookies and Yandex Metrica. By continuing to use the site, you consent to the collection of this data and to its transfer outside the Republic of Kazakhstan as described in section 6.

Without consent, data is processed only where the law allows it. Consent remains valid until the purposes of processing are achieved or until you withdraw it.

5. Cookies and Yandex Metrica

Cookies are small files the site stores in your browser. Our cookies are used only for visit statistics: which pages are viewed and where visitors come from. There is no advertising and no advertising tracking on the site.

You can refuse cookies in your browser settings by blocking them or deleting those already stored. You can switch off Yandex Metrica on all sites with Yandex’s browser extension: https://yandex.ru/support/metrica/ru/general/opt-out.html. The site will keep working.

6. Who receives the data

We do not sell personal data or pass it on for advertising. Access to the data is available to:

• the hosting provider Hoster.KZ, whose servers in the Republic of Kazakhstan run the terrasystems.kz site and email;
• Telegram, where questionnaire answers, including your name, position, phone number and email, reach us as a notification; its servers are located outside the Republic of Kazakhstan and process data under the service’s terms;
• Yandex, which processes Yandex Metrica data on its servers, including outside the Republic of Kazakhstan, under the service’s terms;
• WhatsApp, whose owner processes messages under its own terms; by choosing WhatsApp you use that service directly;
• government authorities, only on the grounds and in the manner established by law.

Cross-border transfer of Yandex Metrica data and of questionnaire answers to Telegram takes place with your consent and under Article 16 of the Law “On Personal Data and Their Protection”.

7. Where and how long we store it

The terrasystems.kz site and email, including messages and questionnaire answers containing your data, are stored on servers in the Republic of Kazakhstan; a copy of questionnaire answers reaches us in Telegram (section 6). Retention periods:

• correspondence with people who did not become clients: no longer than one year after the last contact;
• client data: for the term of the contract and afterwards for the periods required by the laws of the Republic of Kazakhstan, for example for accounting and tax documents;
• Yandex Metrica data: for the periods set by the service.

Once the purpose of processing is achieved or the period expires, the data is deleted or anonymised.

8. How we protect the data

• the site works only over the secure HTTPS protocol;
• only staff who need the data for their work have access to it;
• email and work accounts are password-protected and access is restricted;
• if unauthorised access is detected, we act immediately to stop it and limit its consequences.

9. Your rights

Under Article 24 of the Law “On Personal Data and Their Protection”, you have the right to:

• know whether we hold your personal data and receive information about the purposes, sources and methods of processing, the list of data, and the processing and retention periods;
• request that your data be changed or supplemented where there are supporting grounds;
• request that your data be blocked or anonymised if the conditions for its collection or processing have been breached;
• request the destruction of data collected or processed in breach of the law, and in other cases provided for by law;
• withdraw consent to the collection and processing of data, its transfer to third parties and cross-border transfer, except in the cases set out in Article 8(2) of the Law;
• give or refuse consent to the distribution of your data in publicly available sources;
• protect your rights and legitimate interests, including claiming compensation for moral and material damage;
• exercise other rights provided for by the laws of the Republic of Kazakhstan.

10. How to contact us

Send requests about your data and withdrawals of consent to azat@terrasystems.kz or via WhatsApp at +7 776 207 11 22. Tell us how to address you and how to reach you so that we can find your data.

We reply within ten working days. After consent is withdrawn, we stop processing within fifteen working days or give a reasoned refusal if processing is required by law.

If you believe your rights have been violated, you may contact the authorised body for personal data protection or a court.

11. Changes to this policy

We may update this policy, for example when the law or the site changes. A new version takes effect when it is published on this page; the date is shown at the top of the document.
